Toddler Nutrition – General Terms and Conditions Last updated: 12 November 2025
ARTICLE 1 - DEFINITIONS In these general terms and conditions, the following definitions shall apply: Reflection period: the period within which the consumer can exercise his right of withdrawal; Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur; Duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time; Durable data carrier: any means that enables the consumer or entrepreneur to store information that is addressed to him personally, in a way that allows future consultation and unaltered reproduction of the stored information; Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period; Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance; Distance contract: an agreement whereby, within the framework of a system organised by the entrepreneur for distance selling of products and/or services, up to and including the conclusion of the agreement, exclusive use is made of one or more techniques for distance communication; Technology for distance communication: means that can be used for concluding an agreement, without the consumer and entrepreneur having come together in the same room at the same time; General terms and conditions: the present general terms and conditions of the entrepreneur.

ARTICLE 3 - APPLICABILITY These general terms and conditions apply to every offer of the entrepreneur and to every distance contract and order concluded between entrepreneur and consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, before the remote agreement is concluded, it will be indicated that the general terms and conditions can be inspected on the website and they will be sent free of charge to the consumer as soon as possible upon request. If the distance contract is concluded electronically, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be stored by the consumer in a simple manner on a durable data carrier. In case specific product or service conditions apply in addition to these general terms and conditions, the consumer may always rely on the provision most favourable to him. If one or more provisions in these general terms and conditions are at any time wholly or partially void or annulled, the agreement and these terms remain in force for the rest. Situations not covered by these general terms and conditions should be assessed in the spirit of these terms. Uncertainties regarding the interpretation or content of one or more provisions are to be interpreted ‘in the spirit’ of these general terms and conditions.
ARTICLE 4 - THE OFFER If an offer has a limited period of validity or is made subject to conditions, this shall be expressly stated. The offer is without obligation. The entrepreneur is authorised to change and adjust the offer. The offer contains a complete and accurate description of the products and/or services. Images are a truthful representation of the offered products. Obvious mistakes or errors in the offer do not bind the entrepreneur. Each offer contains such information that it is clear to the consumer what the rights and obligations are, including:
- the price (all prices are in HKD and include applicable taxes unless stated otherwise);
- shipping costs (currently free for all orders – see Shipping Policy);
- the manner in which the agreement will be concluded;
- whether or not the right of withdrawal is applicable;
- the method of payment, delivery and performance;
- the period for accepting the offer or the period within which the price is guaranteed.
ARTICLE 5 - THE AGREEMENT The agreement is concluded at the moment the consumer accepts the offer and fulfils the conditions. If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt electronically. Until confirmation, the consumer may dissolve the agreement. The entrepreneur takes appropriate technical and organisational measures to secure electronic data transfer and ensures a safe web environment. The entrepreneur may – within legal frameworks – check whether the consumer can meet payment obligations and refuse an order with reasons. The entrepreneur will provide the consumer with:
- the address where complaints can be submitted;
- information about the right of withdrawal or its exclusion;
- information on guarantees and after-sales service;
- the data included in article 4 paragraph 3, unless already provided earlier;
- conditions for termination if the agreement lasts longer than one year. Each contract is concluded under the suspensive condition of sufficient availability of the products.
ARTICLE 6 - RETURNING RIGHT When purchasing products, the consumer has the possibility of dissolving the agreement without giving reasons for 30 days. This reflection period starts the day after receipt of the product. During the reflection period, the consumer will handle the product and packaging with care and only unpack to the extent necessary to assess the product. If the consumer exercises his right of withdrawal, he must notify the entrepreneur within 30 days of receipt via e-mail and return the product within 14 days thereafter. ARTICLE 7 - COSTS IN CASE OF RETURNING If the consumer exercises his right of withdrawal, the costs of returning the products are at his expense. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 7 business days after receipt of the returned product or proof of return.
ARTICLE 8 - EXCLUSION OF THE RIGHT OF RETURN The right of withdrawal is excluded for:
- sealed baby formula, baby food, breast milk storage bags, nipples, teats, pacifiers, breast pumps and hygiene products once the seal is broken;
- products made to the consumer’s specifications or clearly personalised;
- products that spoil quickly.
ARTICLE 9 - THE PRICE During the validity period stated in the offer, prices will not be increased, except for changes due to VAT or tax adjustments. All prices are subject to printing and typesetting errors. The entrepreneur is not obliged to deliver at an incorrect price.
ARTICLE 10 - COMPLIANCE AND WARRANTY The entrepreneur guarantees that the products comply with the agreement, specifications, and reasonable requirements of soundness and usability. Any defects must be reported within 7 days after discovery. Products must be returned in original packaging. The warranty period corresponds to the manufacturer’s warranty period. The warranty does not apply if the consumer has repaired the product himself, exposed it to abnormal conditions, or treated it contrary to instructions.
ARTICLE 11 - DELIVERY AND IMPLEMENTATION The entrepreneur will execute accepted orders with due speed but at the latest within 14 days, unless a longer period has been agreed. The place of delivery is the address provided by the consumer. If delivery is delayed, the consumer will be informed within 14 days after placing the order and may dissolve the agreement free of charge. Risk of damage or loss rests with the entrepreneur until delivery to the consumer or a designated representative.
ARTICLE 12 - PAYMENT Unless otherwise agreed, amounts owed must be paid immediately upon ordering. The consumer must report inaccuracies in payment details immediately. In case of non-payment, the entrepreneur may charge reasonable costs communicated in advance.
ARTICLE 13 - COMPLAINTS PROCEDURE Complaints must be submitted fully and clearly described within 7 days after discovery. Complaints will be answered within 14 days. If longer processing is required, a notice of receipt and expected response time will be sent. A complaint does not suspend the entrepreneur’s obligations unless stated otherwise in writing.
ARTICLE 14 - DISPUTES Contracts between the entrepreneur and consumer are exclusively governed by the laws of the Hong Kong Special Administrative Region. Disputes may be submitted to the competent court in Hong Kong.
ARTICLE 15 - SMS MARKETING By agreeing to receive SMS marketing from Toddler Nutrition at checkout, during purchase, or by signing up through our tools, you agree to receive recurring SMS messages (order updates, abandoned-cart reminders, marketing offers, review requests), even if your mobile number is on any do-not-call list. Message frequency varies. Consent is not a condition of purchase. To stop receiving SMS marketing, reply STOP to any message or use the unsubscribe link provided. Alternative unsubscribe methods are not valid. We do not charge for the service, but standard message and data rates may apply. Text HELP for support.
